Please take a few minutes to review these Terms and Conditions (“Terms”). These Terms govern your use of our website, located at Pookiboo.com, and the purchase of our products. By accessing our Site or placing an order, you acknowledge and agree to be bound by these Terms. We encourage you to read them carefully to understand your rights and our business practices.
1. General Provisions
Pookiboo (“the Company,” “we,” “us,” or “our”) reserves the right to provide service to our customers in accordance with our internal policies. All financial transactions are processed securely via Stripe. While your non-financial data may be transferred over various networks, your credit card information is always encrypted during transmission to ensure the highest level of security.
2. Product Standards and Safety
Compliance: Pookiboo represents that all silicone products are manufactured to meet applicable United States FDA food-grade standards.
Supervised Use: All Pookiboo products are intended for use by infants and toddlers strictly under constant adult supervision. By purchasing, the Customer acknowledges and agrees that the Company shall not be held liable for any injury, loss, or damage resulting from the misuse or unsupervised use of our products.
Product Imagery: We strive to display product colors and images as accurately as possible; however, we cannot guarantee that your monitor's display of any color will be perfectly accurate.
3. Purchases and Payments
All orders are subject to availability and acceptance by Pookiboo. We reserve the right to limit quantities or cancel orders at our sole discretion. Payment must be cleared through Stripe before an order is released for fulfillment.
4. Fulfillment and Shipping
Service Area: We ship exclusively within the 50 United States. We do not currently ship to P.O. Boxes or international addresses.
Transfer of Risk: All purchases are made pursuant to a shipment contract. This means the risk of loss and title for the items pass to you once we deliver the goods to the carrier. While we assist with tracking, the Company is not responsible for delays, damages, or losses caused by the shipping carrier.
5. Returns and Refunds
Eligibility: Due to the hygienic nature of baby products, we only accept returns for items that remain unopened, unused, and in their original, sealed packaging.
Return Period: You have 14 days from the date of delivery to initiate a return request.
Shipping Costs: Customers are responsible for all return shipping fees. If a product is determined by the Company to have a manufacturing defect, Pookiboo will provide a prepaid return label.
Refund Processing: Upon receipt and successful inspection of the returned goods, a refund of the full purchase price will be issued to the original payment method.
6. Intellectual Property
The content on Pookiboo.com, including text, logos, and images, is the exclusive property of Shopik LLC and is protected by United States and international copyright and trademark laws. Unauthorized reproduction, duplication, or sale of any site content is strictly prohibited.
7. Limitation of Liability
To the maximum extent permitted by the laws of the State of Florida, the Company’s total aggregate liability for any claim arising out of or related to a purchase shall not exceed the actual purchase price paid for the specific product. We are not liable for any indirect, incidental, or consequential damages arising from the use of our Site or products.
8. Governing Law and Choice of Forum
These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Pinellas County, Florida. Both parties hereby agree to the personal jurisdiction of these courts.
